By creating an account, accessing the Service, or clicking any "Agree" or "Continue" button on the platform, you agree to these Terms of Service ("Terms") and to our Privacy Policy. If you do not agree, do not use the Service. If you are using the Service on behalf of an entity, you represent that you have authority to bind that entity to these Terms.
Compendium ("we," "us," "the Service") is a software-as-a-service platform that helps individuals, families, and licensed professionals organize financial information, generate document drafts from user-provided inputs, store documents, build org-charts and family trees, run AI-assisted analyses, and (optionally) connect with licensed estate-planning attorneys.
We are not a law firm. Document drafts produced by the Service are generated mechanically from templates plus your inputs, refined by AI. They are starting points. Before signing, filing, or otherwise relying on any document produced by Compendium, you must have it reviewed and approved by a licensed attorney in your jurisdiction.
The Service may match you with licensed attorneys who have requested to receive consumer leads. Attorneys pay Compendium for the ability to view qualifying packets and respond with engagement proposals. Important details:
Current prices are listed on the Service. We may change prices on prospective basis with at least thirty (30) days notice for active subscribers.
Subscriptions auto-renew at the end of each billing cycle until cancelled. You can cancel at any time through the Customer Portal; cancellation takes effect at the end of the then-current billing period. No partial-period refunds.
Per-document fees are charged when you purchase a document template. Once the document is generated and delivered to your account, the purchase is final and non-refundable, except as required by law or where the document fails to generate due to a Service defect on our end.
If you believe a charge was made in error, contact billing@thecompendiumco.com within thirty (30) days. We review refund requests case-by-case.
If a renewal payment fails, your subscription enters a grace period of seven (7) days. If still unpaid after that, PRO access is suspended and your account reverts to the free tier (or to advisor-managed if applicable). Your data is retained.
You may not:
The Service stores documents that may contain protected health information ("PHI") — particularly Healthcare Directives, Living Wills, and Healthcare Powers of Attorney. We treat such information as follows:
Our handling of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection, use, and sharing of data described in that policy.
Information surfaced through the Service — including AI-generated analyses, gap detection, suggestions, document drafts, family-tree visualizations, and lead-quality packets — is for educational purposes only. It is not legal, tax, investment, accounting, or medical advice. Decisions about your estate plan, business structure, taxes, finances, or healthcare should be made in consultation with the appropriate licensed professional. Compendium expressly disclaims any reliance you may place on the Service's output without such consultation.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, COMPENDIUM AND ITS OPERATORS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE FULLEST EXTENT PERMITTED BY LAW, COMPENDIUM IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, FROM ANY DOCUMENT OR ANALYSIS PRODUCED BY THE SERVICE, OR FROM ANY ENGAGEMENT WITH AN ATTORNEY INTRODUCED THROUGH THE LEAD NETWORK.
OUR TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED DOLLARS ($100).
You agree to indemnify and hold Compendium, its officers, employees, and contractors harmless from any claims, losses, damages, or expenses (including reasonable attorneys' fees) arising from (a) your use of the Service in violation of these Terms or applicable law, (b) your content, (c) your engagement with any attorney introduced through the Service, or (d) your violation of any third-party right.
You may close your account at any time through the account settings. We may suspend or terminate your access if you violate these Terms or if your account becomes inactive for an extended period (we will email warnings beforehand). Upon termination: (a) your access ends; (b) we retain your data per the retention policy in the Privacy Policy; (c) the survival sections (10–12, 14) of these Terms continue in effect.
Mandatory arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or any engagement initiated through the Service shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall be conducted in Naples, Florida (or by videoconference if both parties agree). The arbitrator's decision is final and may be entered in any court of competent jurisdiction.
Class action waiver. Disputes must be brought in your individual capacity. You waive any right to participate in a class action, class arbitration, or representative proceeding against Compendium.
Exception. Either party may seek injunctive relief in court to protect intellectual property or trade secrets without first arbitrating.
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Subject to Section 14, the exclusive venue for any non-arbitrable dispute is the state and federal courts located in Collier County, Florida.
We may update these Terms from time to time. Material changes will be communicated by email and/or in-app notice at least thirty (30) days before the effective date. Continued use of the Service after the effective date of an update constitutes acceptance.
